History of Death Penalty in Texas Essay During the historical era in the state of Texas, the use of the death penalty was common and frequent; before 1923 districts carried out executions themselves, in the form of hanging. However in 1923 the state of Texas prepared every execution to be carried out by the state in Huntsville using the electric chair as the method of execution. The state of Texas put to death their first prisoner by electrocution on February 8, 1924 and there were four more executions following the very first one on that date. The inmates that were sentenced to death and the areas that the executions were taken place were located in the Huntsville division from 1928 to 1965, and the last electrocution was carried out on July 30, 1964. This state electrocuted a sum of 361 inmates from 1924 to 1964. During the changes and views on capital punishment in the year of 1964, there were legal disputes regarding the death penalty that resulted in the de facto moratorium on executions in the United States. During these challenging times on June 29, 1972 in the case of Furman v. Georgia the United States Supreme Court ruled that each states capital punishment law in the U. S. was illicit since the death penalty was unjustly used and arbitrarily assigned. During that time there were 52 men in Texas awaiting execution, however the governor overturned all their sentences to life in prison and there wasn’t anyone left on death row by March of 1973. In 1977 Texas implemented lethal injection as a form of execution and the first lethal injection was administered on December 7, 1982. Even though executions were put on hold for awhile they resumed in 1982. The following year there weren’t any administered, however throughout the next eight years there were an average of five executions a year. Over the next century 43 prisoners died by execution. In 1989, the United States Supreme Court agreed that in the case of Penry v. Lynough jurors are permitted to think about justifying facts, for example mental retardation and child abuse, when enforcing capital punishment. A number of inmates were vacated as an effect of this choice. The Texas legislature revised the sentencing instructions given to jurors in 1991, ending in a three-question format and its used present day. In 1992, the rate of executions increased rapidly and over the next four years there were 62 inmates executed which means on average there were fifteen executions per year. In 1995 the Texas legislature approved a regulation that required certain death-row appeals to be organized at the same time. Since the numbers of execution has declined per year from the high 30’s to the low 20’s but this doesn’t have anything to with the advancement in the use of DNA. Furthermore, in 2005 the Supreme Court limited the claim of capital punishment when it ruled that inmates who committed capital offenses when they were a minor could not be put to death. Also Texas altered the law so that the prison term for capital murders would be life in prison and ineligible for parole instead of the death penalty; by using this method the outcome that would reflect less inmates being placed on death row and more inmates serving life. This method worked and usually jurors would send about 30 inmates to death row a year, however with the change in the law the jurors on send about 15 inmates to death row. As a result, the residents of death row have declined from 446 prisoners at the beginning of 2005 to 354 inmates at the beginning of 2009. The amount of prisoners presently on death row is the lowest it has been since 1992 (Carson). Current Law In the state of Texas the current law still remains the same, the local courts have authority every illegal felony case. If a person is found guilty of a capital felony, they may be sentence by death, if the State wanted punishment of that nature. Examples of capital felonies are: murder of a public safety officer or firefighter in the line of duty, murder during the commission of specified felonies (kidnapping, burglary, robbery, aggravated rape, arson), murder for remuneration, multiple murders, murder during prison escape, murder of a correctional officer, murder of a judge, murder by a state prison inmate who is serving a life sentence for any of five offenses, or murder of an individual under six years of age. The offender has to be at least 18 years of age or older at the time of the crime, if defended is found guilty the case is appealed to the Court of Criminal Appeals, and if they lose the appeal they may appeal their case to the U. S Circuit Court, and if that isn’t effective they can go to the U. S Supreme Court. When every option is used, in capital cases the Governor of the state of Texas has the authority to award the offender a 30 day reprieve of a set execution (Texas History). The inmate still has rights until he dies. On the last day if life he is allowed one final meal and that final meal will be administered at approximately 3:30 p. . to 4 p. m. Prior, to 6 p. m. , the inmate may take a shower and dress in clean clothes. Everything that is needed and all the preparations for the execution to be carried out will be completed at a prearranged time. After 6 p. m. , the door will be unlocked, and the prisoner will be taken from the holding cell. The inmate will be removed from the cell location and into the execution chamber and held to a gurney. A medically skilled person that is not to be known shall insert an intravenous catheter into the individual’s arms and cause a saline solution to flow. Discussion In my opinion I feel as though the state of Texas has zero tolerance. If a person commits a crime the punishment will be harsh and swift. I think that the way this particular state administers the death penalty is ridiculous. As I stated previously there were 93 executions that took place in the course of three years and I feel that at least ten percent of those inmates were probably not g uilty or couldn’t afford a decent lawyer to represent them so they ended up on death row. Once the state began to get scrutinized by the public they took a step back and began to pay attention to the high numbers of executions that took place in there state. However those laws were set in place that only minimized the numbers slightly and the jurors still chose to place prisoners on death row. Currently there are 337 people on death row waiting to die. This number in my opinion is rather large and most of those people will not make it to the set date to die for the most part. Jurors are ready to send people to death row at any given moment as long as the offender meets the death eligible crimes. They are not considering how expensive it is to hold someone on death row. Currently there are 337 people on death row and the average cost per day to house an inmate on death row is $59. 98. So if you take $59. 98 multiply that by 337 inmates you will get $20,213. 26 to house 337 death row inmates a day; let’s take it a step further and multiply $20,213. 26 by 365 days in a year and that equal $7,377,839. 90 to house 337 prisoners on death row a year. I can take this information another step further by saying the average time a person is held on death row is eight years and ten months and that amount equals to about $59,040,713. 20 to hold an inmate on death row (Texas Department of Criminal Justice). I know may factors come into play, for death row inmates such as some inmates may die, others maybe found innocent, and some could possibly receive a lesser sentence, however the likelihood for that miracle to happen and it puts a dent in the number of prisoners on death row is probably not going to happen. All of this money is being spent on these specific inmates this isn’t even factoring in the cost of the administering the execution or the amount to hold an inmate in prison who is just serving a form of sentence. The state and government puts all this money into a broken prison system and really is just wasting money on killing someone who killed someone. Overall I feel that the death penalty is too expensive; however I am a religious person so I can’t really say if I’m for or against capital punishment, because I feel that no one man should have the power to inflict pain or cause death towards a person. GOD is the only one who has the power to give and take and he is a forgiving GOD so why should someone feel they need to inflict death on another when GOD has possibly already forgiven them, especially when our government and or court system is held â€Å"In GOD We Trust†. Does this statement make me a hypocrite possibly, but I have a daughter and children are my soft spot and that in my opinion should be the only death eligible crime. Conclusion Overall, I feel as though the death penalty is put in place like any other law. This is an historical fact that probably will last for a long time. During this research I’ve learned so much about the state of Texas, dating back to the early nineteen hundreds. It’s interesting to see the world evolve and how things changed but in a way they don’t, everything just advances. My view of the death penalty and capital punishment will never change and given these facts that I’ve learned from this research it just helped me understand why I feel the way I do now. This is a broken system that we citizens have to depend on, changes need to be made swift and quickly, the same way the State of Texas executes a person, that’s how the system needs to change and improve for the sake of America and everyone that living in it. Hopefully one day the system can work together and flow without any concerns or problems that seems to occur in our system often, however I don’t see the day where that will happen anytime soon.

Suggestibility of very young children Bruck, Ceci, Francoeur & Barr 2 studied the influence of postevent suggestion on children’s accounts of their visit to the doctor. After their DPT shots, children were given one of three types of feedback: (1) that the shot hurt (pain affirming); (2) that it did not hurt (pain denying); and (3) that the shot is over (neutral). One year after, the children were again visited, and were again given either pain denying or neutral feedback in three separate visits. They were als o given either misleading or non-misleading information about the actions of the nurse and doctor. Children given pain denying feedback reported that they did not cry or hardly at all, and said the shot did not hurt, or at least hurt less than the children who received neutral feedback. Also, children who were given misleading information about the actions of the nurse and doctor made more false allegations about their actions than children not given misleading information. ... The study showed that timing of the misinformation affected the memories of single and repeated events, depending on the combination of event-misinformation and misinformation-test delays rather than overall retention interval. In the study by Milne and Bull,4 and that of Holliday,5 the objective was to examine if the cognitive interview would enhance the recall of events when used with children, and whether the cognitive interview increased children’s resistance to suggestive questions. (The cognitive interview focuses on the cognitive processes respondents use to answer survey questions, and the interview is held in some private location such as a laboratory environment.6) In the experiment, eight to ten year old children were shown a video recording of a magic show. The following day they were interviewed individually, some using cognitive interview and some using structured interview. A pre-set list of leading or suggestive questions was given to the children either before or after the interview. The findings were that the children who were interviewed using the cognitive interview had a better and more accurate recall of significantly more details. They were also more resistant to suggestive questions subsequently asked. In the textbook Education Psychology, Anita Woolfolk describes prejudice as â€Å"prejudgment or irrational generalization about an entire category of people† (Woolfolk, 2008). Prejudice is a major problem in everyday lives. It is happening all around us. Prejudice can be a positive or negative thing. It is usually negative, brings people down, and not all the way true. Discrimination is â€Å"treating or acting unfairly toward particular categories of people†. (Woolfolk, 2008) Conflict Research Consortium says â€Å"Prejudice and discrimination are negative manifestations of integrative power. Instead of bringing or holding people together, prejudice and discrimination push them apart†. By about the age of four, children are aware of differences among people, like appearance, language and names. African Americans were considered worthless a long time ago. They were used as slaves. There were segregated schools, buses, and stores. In 1963, Martin Luther King, Jr. gave his speech about whites and blacks should be treated equally. The laws started to change after that point in time. I do not think prejudice, stereotyping, and discrimination has gone down. I think it is still a big factor in society. They are learning and forming opinions about people and events all over the country and the world. As a result, there is more of a need and opportunity to help children learn to understand and value diversity. † (Prejudice, 2007) Children need to know why people are different and do things differently. Media is still a big part of prejudice, stereotyping, and discrimination. Children see what actors and actresses wear and how they act in movies. They see the commercials about food (if I eat this, I will look like that). I think as teachers and parents we need be good examples for children today. They should not say bad things about people in front of children. Teachers and parents need to tell children that it is okay to be friends with a person who is different. I found an article on this website that parents have asked some questions about prejudice. Some of the questions are â€Å"Is there prejudice in public schools? Yes. Do educators hold different expectations for minority children? Yes. Are children denied access to advanced or gifted placement classed based on racial biases? Yes. Can the battle against prejudice in public education be successfully fought and won? Yes†. (Prejudice and Discrimination In Public Schools, 2001) I really like the last question, prejudice can be fought and won. It all starts at home, parents are their child’s first teacher. Children see what their parents say and how they act. One example of stereotyping that I thought of was that I did an internship my senior year of high school. I helped a second grade teacher. After a couple of times going into the class, the teacher would always whisper to me about this little girl. She says she never gets anything right, she always has messy hair, she is always talking, and the list went on and on. One Sunday I was at church and I saw that girl. I told my mom what the teacher had told me about that girl. My mom said that she has had a hard couple of months. She told me that the little girl’s mom had left her and her family. I felt really bad for the girl. After that day, I started to recognize the girl. I would say hi to her when I would see her. I did not care what she looked liked. To this day, the girl always comes up to me in church and gives me a hug. â€Å"Stereotyping often results from and leads to prejudice. Prejudice leads to discrimination. Prejudice can be spread by the use of propaganda. Language, particularly slang, is often used to dehumanize members of certain groups of people†. (Grobman, 1990) All three of these judgments go together. It is hard to do one without doing the other two. It is really bad that people rather make judgments about people than getting to know them. People really need to take the time to know the person or group of people before they start making judgments. It is sad that young children are making judgments about people. When people are seeking new opportunities in other countries, China and India is popular choices for investor as the two most populous on the Earth. Both are emerging economies that have illustrated average GDP growth greater than 7 percent over the few years*. Noticeably, both India and China are largest avoided by the global economics crisis in 2010,maintaining above GDP growth when western countries are suffering economics contraction. Despite of successful changes, we still need to consider further elements for our investment. It includes regimes, laws, economy environment and population. However, if I want to do a mobile game company, I will choose China. In this essay, I will discuss above elements in China and India and also describe why China is better to do a mobile game company. At first, the regime background and regulation are two basically part to decide investment. Over the past 30 years, China has witnesses a continuing transition a capitalist political economy with a highlighting on market competition, international economic integrations and capital accumulation. In other words, It has opened its door to the direction of liberalization. Therefore, China requires to join the WTO for the demand to open its markets in anticipation, which is a new program of legal reform motivated. Thus, Chinese government is reducing to control business whose ownership is government-dominated or state-owned enterprise (SOES) but consolidate SOEs in some sectors to be global leader in their areas. In addition, in e-business this sector, the tax remains vague, generally lower than other nations, because China has developed their e-business later than others and is immature. Yet it also means more intellectual property issues. Similarly, a process of market liberalization is also building in India. Some have claimed that (Vollmer, and Sabine, 2013) that, prior to 1991, FDI was extremely regulated and was banned in almost sectors by Indian government. Yet a second wave of reforms has forced the liberalization process from 1991. It has opened the India economy for foreign investment in almost categories. A variety of measures were taken by India government, such as current account convertibility, allowing foreign institutions to invest in securities and shares of India companies. The Foreign Exchange Management Act (FEMA) Regulations, which is most import law for foreign invertors, has banned some sector like atomic energy and banking. In other sectors, such as mining, telecommunications, and pharmaceutical, the proportion of investment in a company is covered by the FEMA regulations. Lately, many FDI has required Foreign Investment Promotion Board (FIPB) approval. Obviously, industries are requiring a license to operate, and to need for approval for restricted industries. A of critical goals for government is that to increase the FDI approvals to actual percentage. According to survey evidence (Bajpai and Jeffrey, 2000), FDI approvals were of the order of $54,268 million from April 1991 to September 1998, while actual FDI during the same time was a mere $11,806 million. Thus, actual FDI as a proportion of FDI approved was only 21.7 percent the same ratio is much higher in China. Furthermore, in India, FDI approval is base on the national level. Therefore,  licensing requirements, registration, and mandated. Investors have to control separate negotiations at the local level should like approvals be required because approval are not managed through national level offices. So, if we do business in India, we cannot avoid a complex of approval and also face some corruption from government. For tariff, since 1990 a dual corporate income tariff regime has maintained by China: one regime for Chinese Delivered Ex Ship (Des) and another regime for Foreign-Invested Enterprises (FIEs). According to An (2012), to compare with Des, FIEs receive preferential tariff treatments provided by the Chinese government, base on dual corporate income tariff. Many Foreign investments were enticed into China because of the dual corporate income tariff. In order to compare with India, the tariff rates are approximately the highest in the world (Mohommed,2014). This limits its attractiveness as an export platform for labor-intensive manufacturing production. Nirupam and Jeffrey (2000) have found that, on quotas and tariffs, India out of 59 countries being ranked. India is ranked 52 on average tariff rate in 1999. Reductions of tariff rates (between 0 and 20 percent) required much greater openness to averages in East Asia. Most significantly, as many exporting countries of East Asia has been successful over past several decades, tax tariff on imported goods used for export and on imported inputs into export production should be duty free. For instance, tariff in agriculture, An (2012) has argue that the average bound rate in other developing countries for agricultural imports such as China and Brazil is 16 percent and 35 percent respectively, whereas India is 113 percent and higher than its 37 percent average bound rate for non-agricultural products. Therefore, tariff will be a huge barrier for foreign investor to enter India market but China has not this major impediment to larger FDI inflows in.
